CONECTIO GENERAL TERMS AND CONDITIONS

Please read the General Terms and Conditions (hereinafter, the "GTC") carefully before accessing or using the website (hereinafter, the Platform). The following GTC govern access to, browsing of, registration on and use of the Platform. The conditions published at the time the User accesses the Conectio Platform shall be understood to be in force.

If any provision of these GTC is declared inapplicable or invalid, such provision shall be limited or eliminated to the minimum extent necessary so that the remaining conditions and obligations remain in full force and effect and are binding.

ACCEPTANCE OF THE TERMS AND CONDITIONS

By registering on and using the Platform, the User (hereinafter, the "User" or the "Candidate") accepts and undertakes to comply with all the GTC established in these Terms and Conditions. Any User is able to register on or use the Platform, provided they accept the GTC, as well as all other policies and principles governing the operation of the Platform that are detailed below.

By registering for or using any CONECTIO service, the User accepts these GTC, as well as the policies related to the provision of the services, including the Privacy Policy, and any supplementary document published on the Platform.

If the User uses CONECTIO's services to apply to a company's selection process, the User accepts that their data may be transferred to such company in order to facilitate the hiring process, in accordance with the provisions of the Privacy Policy. CONECTIO may share the User's profile, including their skills and preferences, with companies that match the requirements established by the User. The User undertakes to provide truthful information and to act in accordance with the provisions set out in this document and with applicable regulations.

The service offered on this Platform is subject to:

  1. These General Terms and Conditions;
  2. Particular Conditions that may be published on the Platform and which may replace, supplement and/or modify these GTC;
  3. Applicable laws in force, sector-specific regulations, and the general criteria and practices of the recruitment sector.

CONECTIO reserves the right to modify the presentation, configuration and content of the Platform, as well as the conditions required for access to and/or use of it. Access to and use of the contents and services after the entry into force of such modifications shall imply acceptance thereof.

The User may register on the Platform using their LinkedIn account, which implies that CONECTIO may access and extract certain data from their LinkedIn profile (such as work experience, education, skills, profile picture and other publicly available data) with the sole purpose of automatically completing the User's profile on the Platform. Such access shall always take place with the User's prior consent, in accordance with the Privacy Policy.

DETAILS OF THE OWNER OF THE Platform

In compliance with the duty of information set out in article 10 of Ley 34/2002, of 11 July, on Information Society Services and Electronic Commerce (Law 34/2002, LSSI-CE), the details of the owner of the Platform are set out below:

USE OF THE Platform AND SERVICES

CONECTIO provides advanced talent-selection solutions in the digital sphere, designed so that users can find the right job at companies that match their skills and values. Users registered on the Platform can benefit from innovative tools that facilitate the job-search process, improving accuracy and effectiveness in connecting with companies.

The main services offered by CONECTIO include, but are not limited to:

  • Users can easily register on the Platform by creating a profile with their professional information, including contact details, work experience and employment preferences. This profile enables CONECTIO to identify opportunities that match their skills and expectations.
  • Using its own technology, CONECTIO ensures that the selection process is more efficient, connecting candidates with the companies that best match their profile. This service takes into account both technical skills and cultural compatibility with companies.
  • Users will receive job recommendations based on their preferences and skills, without having to go through lengthy selection processes or manual searches for offers.

Key features of CONECTIO's services:

  • The user grants CONECTIO permission to collect and supplement the information provided with the data published on their LinkedIn profile, with the aim of enriching and improving the recommendations and job opportunities. This collection is carried out securely and always with the user's explicit consent, in accordance with CONECTIO's Privacy Policy.
  • CONECTIO may carry out cognitive aptitude tests and personality tests that help identify the most suitable jobs for each candidate, ensuring a perfect match with companies. These tests are not intelligence exams, but rather tools designed to improve the accuracy of the recommendations.
  • In addition to finding jobs that match the user's skills, CONECTIO also seeks to ensure that the selected companies share the candidate's values and culture, which increases the chances of success and satisfaction in the role.
  • Users will receive immediate notifications about new job opportunities that match their profile, or when a company shows interest in their application. CONECTIO will contact them through the communication channels they have specified, such as email, telephone or other means such as WhatsApp or other channels associated with their phone number, always in accordance with the Privacy Policy.

The services provided by CONECTIO are designed to be used easily and effectively by candidates. The Platform is optimised to help users stand out in the competitive digital world and find jobs that not only meet their technical skills but also their personal and professional expectations.

Within the framework of the use of the Platform, the data provided by users may be shared with companies seeking candidates, always complying with the privacy terms detailed in CONECTIO's Privacy Policy. This data is used solely to facilitate the selection process and to ensure the best match between the candidate and the companies.

The Platform allows Users to register using their LinkedIn credentials. By choosing this option, the User authorises CONECTIO to collect and process the data necessary from their LinkedIn profile to create and optimise their account on the Platform. This data shall be used exclusively to provide the services offered by CONECTIO, in accordance with these GTC and the Privacy Policy.

Finally, CONECTIO also offers the possibility for candidates to receive recommendations based on feedback from companies and the results of previous tests, constantly adjusting profiles and job suggestions in line with the evolution of each user in the labour market.

REGISTRATION ON THE Platform

The User may access CONECTIO's services through a personal registration process, which will enable them to create a profile and access the job opportunities offered that match their skills, experience and preferences. CONECTIO will use the data provided to search for and present to the User those opportunities that best suit their profile.

The User warrants that the information provided during registration is accurate, complete and truthful. Any inaccuracy in the information provided shall be the sole responsibility of the User.

The User may register on the Platform through a manual process or by using their LinkedIn account. In doing so, the User expressly authorises CONECTIO to extract and use the information from their LinkedIn profile, such as professional experience, skills, photograph and any other publicly available data, in order to automatically complete their profile on the Platform.

If they opt to register via LinkedIn, the User declares that the information contained in their LinkedIn profile is truthful and up to date. CONECTIO shall not be liable for inaccuracies in the data extracted from LinkedIn.

CONECTIO cannot guarantee the identity of the Users who register on the Platform and assumes no liability whatsoever for any improper use that an unauthorised third party may make of a registered account.

The User is responsible for ensuring that the information registered in their profile is truthful and up to date. CONECTIO shall not be held liable for the consequences arising from the inaccuracy of the data provided.

The User is responsible for safeguarding their password for accessing the Platform and must immediately notify any unauthorised or suspicious use of their account.

Any use of the Platform made using the User's password and access credentials shall be deemed to have been carried out by said User, who shall be responsible for the actions performed under their account.

CONECTIO reserves the right to reject any registration request or to cancel previously accepted registrations, without having to justify the reasons and without generating any right to compensation or indemnity on the part of the User.

PRICING POLICIES

CONECTIO provides digital talent-selection services under different modalities. Certain specific services or additional functionalities may be subject to fees in accordance with the pricing policies in force, which shall be published on CONECTIO's website. These policies will determine the applicable fees, including, but not limited to, advanced candidate assessment, the provision of detailed reports and other additional services.

CONECTIO offers services directly to individual users seeking employment, with free access to the registration Platform and to the candidate profile. However, there may be premium services subject to an additional cost, which shall be clearly specified on CONECTIO's website.

Payment for these services, in the event that the User contracts them, shall be made through the CONECTIO Users Platform, by means of a payment model managed with a debit or credit card through an external payment provider, enabled to process recurring or one-off charges, depending on the nature of the service contracted.

The prices of CONECTIO's premium services may vary depending on the modality contracted. CONECTIO may offer special promotions or temporary discounts, which shall be announced on the website and shall be subject to the terms and conditions indicated in each promotion.

The fees applicable to the services contracted by the User shall be those in force at the time of contracting. Any modification of prices shall be notified to Users in advance, who shall have the right to cancel the service if they do not agree with the new fees before they come into effect.

USE LICENCE AND CONTENT

CONECTIO grants the User access to the Platform under a limited, non-exclusive, non-sublicensable, non-transferable and revocable licence. The use of CONECTIO's Platform shall at all times be personal, exclusively intended for non-commercial purposes, and in accordance with these GTC. Any use contrary to the provisions of the GTC shall result in the revocation of this licence.

By making use of the services of the Platform, the User grants CONECTIO and its collaborators a perpetual, irrevocable, worldwide, non-exclusive, royalty-free and fully sublicensable licence to use, reproduce, modify, adapt, publish, translate, distribute, perform and display the content provided by the User, provided it is for the purposes established by CONECTIO for the provision of its services.

The User, by using the Platform, accepts and understands that CONECTIO may retain their content for as long as is necessary to fulfil the specific purposes for which it was collected, in accordance with the data-protection regulations in force.

CONECTIO shall not be liable to third parties for the content or accuracy of any material submitted by the User. CONECTIO reserves the right to remove any content, information or announcements published on the Platform if it considers that they infringe these GTC, applicable regulations, or the rights of third parties, without the need for prior notice.

CONECTIO shall have the right to investigate any suspicious conduct related to the use of the Platform that may violate the GTC or applicable legislation. It shall also cooperate with the competent authorities in the investigation of any unlawful activity or activity that infringes the rights of third parties, providing the information required in accordance with the law.

By granting access to their LinkedIn account, the User grants CONECTIO a limited, non-exclusive and revocable licence to collect the necessary public data from their profile, with the sole purpose of completing and enriching their profile on the Platform, always respecting the applicable data-protection regulations.

OBLIGATIONS OF THE USER

If the User becomes aware of the existence of any unlawful or illegal content, content that is contrary to the law or that may constitute an infringement of intellectual and/or industrial property rights, they must immediately notify CONECTIO so that it can proceed to adopt the appropriate measures. The use of the Platform for purposes other than those set out in these GTC is expressly prohibited. CONECTIO shall not be liable for the improper use or manipulation of the Platform by the User.

The Platform may provide access to a multitude of texts, graphics, drawings, designs, code, software, photographs, images, expressions and information belonging to CONECTIO or to third parties to which the User may have access. The User assumes responsibility for using the Platform in a lawful, diligent, honest and correct manner, always respecting the principles of good faith and complying with the applicable legislation and these GTC.

By way of example, but not limitation, Users must refrain from:

  • Registering or communicating false data: Not using inaccurate, incomplete or outdated information in their registration on the Platform, nor accessing using the name, identifying data or access credentials of another User, nor impersonating any person. The User undertakes to inform CONECTIO of any modification of the data provided.
  • Causing damage to or altering the Platform: Not carrying out malicious or intentional actions that harm or modify the Platform, nor introducing viruses or harmful software. Nor shall they attempt to scan, probe the vulnerability of, or breach the security of, CONECTIO's systems and networks.
  • Using the Platform for illegal activities: Refraining from using the Platform for fraudulent purposes or for carrying out any unlawful or criminal activity.
  • Reproducing or distributing content without authorisation: Not copying, distributing, transforming, modifying or reproducing the information or content hosted on the Platform without due authorisation from the owner of the corresponding rights.
  • Sending offensive or illegal material: Not using the Platform to send, store or disseminate content that is illegal, offensive, pornographic, abusive, defamatory, obscene, threatening or that violates intellectual property rights, privacy or any other right, including content with computer viruses or spam.
  • Infringing laws or the rights of third parties: Not downloading, sending or distributing content or applications that infringe the laws in force or the rights of any person or entity.
  • Encouraging illegal practices: Not promoting or encouraging third parties to carry out any of the aforementioned practices.
  • Not sending or uploading inappropriate content, including but not limited to:
    • Defamatory, obscene, offensive or threatening material.
    • Content that promotes violence or discrimination on grounds of race, sex, religion, nationality, disability, sexual orientation or age.
    • Information protected by intellectual property rights, privacy or otherwise without the appropriate consent.
    • Personal data of third parties without explicit consent.
    • Content that promotes illegal activities, harassment, abuse or invasion of privacy.
    • Content that may cause annoyance, unnecessary anxiety or alarm to other persons.

CONECTIO'S RESPONSIBILITIES AND WARRANTIES

CONECTIO is not responsible for the information, files or any other content that Users and/or Users upload or send to the Platform. CONECTIO does not validate such content, and therefore shall not be liable, either directly, indirectly or subsidiarily, for any damages of any kind arising from the communications or content included on the Platform by Users.

By way of example, CONECTIO shall not be liable for:

  • The satisfaction of the User's personal needs or requirements in relation to the resources provided by the Platform.
  • Direct or indirect damages and/or intangible damages, including personal injuries suffered as a result of improper use of the Platform.
  • The loss of reputation, image, or data that may occur during the use of the Platform.
  • The lack of availability, maintenance and effective operation of the Platform, excluding, to the maximum extent permitted by applicable law, any liability for damages that may be due to the unavailability or the lack of continuity of operation of the Platform.
  • Any defect, error or operating problem of the Platform.

Consequently, CONECTIO does not guarantee that the use that Users may make of the contents and services included on the Platform will comply with these GTC, or that they will do so diligently. CONECTIO cannot guarantee the identity of any other User of the Platform.

CONECTIO reserves the right of admission to and exclusion from the Platform at its sole discretion. Any User who does not comply with the rules set out in these GTC or who makes inappropriate use of the Platform may be excluded from it without prior notice.

CONECTIO reserves the right to:

  • Remove, suspend, edit or modify the content of the Platform at its sole discretion, at any time, without prior notice and for any reason.
  • Remove, suspend or block the access of any User to the Platform.

CONECTIO reserves the right to access, read, preserve and disclose any information that it reasonably considers necessary in order to:

  • Comply with applicable legislation or any judicial or governmental requirement.
  • Enforce these GTC, including the investigation of potential breaches.
  • Detect, prevent or manage fraud, security or technical issues.
  • Respond to User assistance requests.
  • Protect the rights, property or safety of CONECTIO and its Users.

Notwithstanding the above, CONECTIO declares that it has adopted all the necessary measures, within its capabilities and the state of technology, to guarantee the operation of the Platform and to prevent the transmission of viruses and other harmful components to Users and/or Users.

SUSPENSION AND CANCELLATION OF SERVICES

CONECTIO may temporarily suspend, and without prior notice, accessibility to the Platform for reasons of maintenance, repair, updating or improvement necessary for its proper functioning.

CONECTIO reserves the right to remove, limit or prevent access to the Platform when technical difficulties, external problems or any circumstance beyond CONECTIO's control arise that, in its judgement, compromise the levels of security or affect the proper operation of the Platform.

CONECTIO shall not be liable for the lack of availability, maintenance or effective operation of the Platform, excluding any liability for damages arising from the lack of access, interruptions or lack of continuity of operation, to the maximum extent permitted by applicable law.

Nor shall CONECTIO assume liability for the cancellation or suspension of services within the Platform due to causes not attributable to the company. However, CONECTIO undertakes to do everything possible to resolve any problem that may arise and to offer assistance to the User in order to reach a prompt and satisfactory solution.

CONECTIO shall not be liable for cases of force majeure, understood as those events that make the use of the Platform impossible, such as Internet network blockages, actions or omissions of third parties, or any other cause beyond CONECTIO's control that prevents the normal use of the services.

The Platform may contain hyperlinks that allow the User to access other Platforms or third-party websites. CONECTIO shall not be liable for the content, information or services that may appear on such sites, which shall be offered solely for informational purposes and do not imply any type of relationship, acceptance or endorsement between CONECTIO and the owners of such content or Platforms.

CONECTIO shall not be responsible for establishing the General or Particular Terms and Conditions of the services offered by third parties through the Platform, and therefore shall not assume liability for such services, products or content.

CONECTIO has no control over the information, products, services, operation or quality of other websites linked from the Platform. Therefore, it cannot assume any liability for aspects related to such websites, such as their access, operation, quality or reliability.

In the event that CONECTIO becomes aware that the activity or information accessible through any link is unlawful or harms the property or rights of third parties, it will act diligently to remove or disable such link as soon as possible.

CONECTIO reserves the right to unilaterally terminate the contracted services and access to the Platform in the event of serious breach by the User of the obligations set out in these General Terms and Conditions, or in the event that the User's use of the Platform endangers the security or integrity of the services or of the other users.

In the event of termination of the service due to breach by the User, CONECTIO may demand the return of any information provided, and may invoice any additional cost related to the termination, in accordance with the provisions of the particular conditions of the service.

INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS

The Platform, including, by way of example but not limitation, its programming, editing, compilation and other elements necessary for its operation, the designs, logos, texts and/or graphics mentioned in these GTC, are the property of CONECTIO.

Users acknowledge that the reproduction, modification, distribution, commercialisation, decompilation, disassembly, use of reverse engineering techniques or any other means to obtain the source code, transformation or publication of any result of unauthorised benchmark tests of any of the elements and utilities integrated within the development constitutes an infringement of CONECTIO's intellectual property rights, and therefore undertake not to carry out any of the aforementioned actions.

All contents of the Platform are duly registered and protected by Intellectual and Industrial Property regulations, as well as mandatorily recorded in the corresponding public registries. Regardless of the purpose for which they are intended, their total or partial reproduction, use, exploitation, distribution and commercialisation requires in any case prior, express and written authorisation from CONECTIO.

The designs, logos, texts and/or graphics not belonging to CONECTIO that may appear on the website or on the Platform belong to their respective owners, who shall themselves be responsible for any dispute that may arise in relation thereto.

Third-party holders of intellectual and industrial property rights over photographs, logos, and any other symbols or content included on the Platform have granted the corresponding authorisations for their reproduction, distribution and making available to the public.

INDEMNITY

Users undertake to protect and hold CONECTIO harmless from any damage, liability or cost that may arise from claims by third parties against CONECTIO, its directors, representatives or employees as a result of material provided by Users, misuse of CONECTIO's services or breach of these GTC.

CONECTIO shall inform Users of any claim through the data provided upon registration for the services. By accepting these GTC, Users acknowledge that CONECTIO has no direct or indirect liability in the services contracted between the User and each User or third parties.

DATA PROTECTION

Both Parties declare that they comply with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council, of 27 April 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter, "GDPR") and Ley Orgánica 3/2018, de 5 de diciembre, de Protección de Datos Personales y garantía de los derechos digitales (Organic Law 3/2018, of 5 December, on the Protection of Personal Data and guarantee of digital rights, hereinafter "LOPDGDD") in any processing of personal data that may arise in connection with this Contract.

In the event that the User decides to register via LinkedIn, CONECTIO shall process the personal data extracted from their profile in accordance with the Privacy Policy and solely for the purposes set out in these GTC. The information collected from LinkedIn shall be limited to the data necessary to provide the services offered on the Platform.

CONECTIO guarantees that the access to and processing of data obtained from LinkedIn shall be carried out securely, respecting the privacy settings established by the User on that Platform.

This Clause is intended to establish the conditions under which CONECTIO, as Data Processor, shall carry out the processing of personal data inherent in the service contracted by the User, in their capacity as Data Controller of the personal data.

CONECTIO, as Data Processor, undertakes to:

  • Carry out the processing of personal data necessary for the correct provision of the Services provided to the USER, in accordance with the instructions indicated by the User at any given time. Under no circumstances may it use the data for its own purposes or for any other purposes different from those established.
  • Process the data in accordance with the User's instructions, as indicated in this Contract. If CONECTIO considers it necessary to carry out data processing for a purpose other than that indicated, it shall first request written authorisation from the User. In the absence of such authorisation, CONECTIO shall not be able to carry out such processing. If CONECTIO were to consider that any of the instructions provided by the User infringes the GDPR or LOPDGDD, it shall immediately inform the USER.
  • CONECTIO shall keep and safeguard under its control the personal data of the User, to which it will have access as a result of the provision of its Services, and shall not disclose, copy, reveal, transfer, assign or communicate in any other way, whether verbally or in writing, by electronic means, paper or by computer access – not even for their conservation – to any third party, nor the elaborations, evaluations or similar processes cited above, except in the cases necessary to carry out the requested service and/or the authorisations that may have been granted.
  • Therefore, the processing of personal data derived from this Contract obliges CONECTIO to the duty of secrecy and confidentiality during the term of the relationship with the User.
  • Ensure that the personal data to which it has access is processed only by those employees whose intervention is strictly necessary for the provision of the service and who need to know it in order to correctly carry out the execution of their functions. CONECTIO shall communicate to the employees the security measures that will apply and the duty of secrecy and confidentiality that they must observe in relation to the personal data.
  • Adopt such technical and organisational measures as are necessary to guarantee the security of the personal data to which it has access and to prevent its alteration, loss, unauthorised processing or access, taking into account the state of the art, the cost of implementation, the nature, scope, context and purposes of the processing, as well as the risks of varying likelihood and severity for the rights and freedoms of the data subjects, which, where applicable, shall include:
    • Guaranteeing the ongoing confidentiality, integrity, availability and resilience of the processing systems and services.
    • Restoring the availability of and access to personal data in a timely manner in the event of a physical or technical incident.
    • Pseudonymising and encrypting personal data, where appropriate.
    • A process for regularly testing, assessing and evaluating the effectiveness of the technical and organisational measures to ensure the security of the processing.
  • CONECTIO undertakes to keep a record of all categories of processing carried out on behalf of the User.
  • Notify the USER, without undue delay, and, in any event, within a maximum period of 72 hours and through any reliable means set out in the Communications clause, of any breaches of the security of the personal data in its custody of which it becomes aware, together with all the information relevant for the documentation and communication of the incident. However, notification shall not be required where the security breach is unlikely to result in a risk to the rights and freedoms of natural persons.

Specifically, the following information shall be provided at a minimum, in clear and plain language:

  • A description of the nature of the personal data security breach, including, where possible, the categories and approximate number of data subjects affected.
  • The name and contact details of the data protection officer or other point of contact where more information can be obtained.
  • A description of the possible consequences of the personal data security breach.
  • A description of the measures taken or proposed to remedy the personal data security breach, including, where appropriate, the measures taken to mitigate any possible adverse effects. Where, and insofar as, it is not possible to provide the information at the same time, the information shall be provided in phases without undue delay.
  • Support or cooperate with the User, where necessary, in carrying out privacy impact assessments relating to the personal data to which it has access, as well as in carrying out prior consultations with the supervisory authority, where applicable. It shall also cooperate with the competent Supervisory Authority, at its request, in the performance of its tasks. To this end, it shall provide all necessary technical and organisational information.
  • Make available to the User, upon request, all information necessary to demonstrate compliance with the obligations set out in this Contract, in order to verify compliance with the provision of the services.
  • Once the provision of the services has ended, CONECTIO shall, at the User's choice, return any type of medium or document containing the personal data, without retaining any copy thereof or of the information generated or supplied, or proceed to the secure and confidential destruction thereof from any medium, adopting the organisational and technical measures necessary to guarantee the non-recovery of the data and, therefore, their non-use subsequently or access by unauthorised third parties.

Notwithstanding the foregoing, in the event that there is a legal obligation requiring CONECTIO to retain certain information for a period of time, such data must remain blocked, and may not be used for other purposes, being retained solely at the disposal of the relevant Authorities to address any liabilities arising from the processing, during the period of prescription thereof, after which they must be definitively deleted.

If it becomes necessary to subcontract any processing, or part thereof, that involves access to and/or processing, in whole or in part, of personal data, CONECTIO shall be permitted to subcontract such processing with third parties, provided that they comply with the data-protection standards set out in these Terms and Conditions and in applicable regulations (such as the GDPR). CONECTIO shall ensure that these third parties implement security measures equivalent and proportional to those applied by CONECTIO, and undertake by contract to comply with the obligations established for the correct management of the User's personal data.

In the event that the subcontracted services are essential for the execution of these Terms and Conditions, it shall not be considered necessary to obtain specific authorisation from the User, provided that such third parties comply with the applicable security and privacy standards.

CONECTIO shall inform the User of the existence of these third-party processors in its Privacy Policies, detailing the categories of subcontracted services.

CONECTIO shall process the Personal Data within the European Economic Area or another area considered by the applicable regulations to offer an equivalent level of security, processing it outside this area in any case through sub-processors that guarantee an adequate framework of protection under the applicable regulations or through the execution of standard contractual clauses adopted by the European Commission or, where applicable, the obtaining of authorisation for the transfer from the Competent Supervisory Authority.

Each Party shall be subject to liability and shall indemnify the other for any type of claim that arises or is alleged to have arisen as a result of negligent or wilful acts or omissions on the part of either of them, or of the personnel in their charge, that breach the provisions of the regulations in force, including the assumption of any administrative penalties that may have been incurred.

Right to information: Each of the signing Parties and, where applicable, their representative, are informed that the personal data of their representatives and employees shall be processed by the other Party for the purpose of enabling the development, performance and monitoring of the agreed service-provision relationship, as well as the data that may be exchanged during the provision of the Services, the basis for the processing being the performance of the contractual relationship. The identification of the Parties is a necessary requirement for the formalisation of this Contract, and therefore it cannot be carried out without such requirement being met.

The data shall be retained for as long as this remains in force and even afterwards, until any possible liabilities arising from it have expired. The Parties' data may be communicated to banks and financial institutions for the management of collections and payments, and to Public Administrations in the cases provided for by Law for the purposes defined therein.

The Parties shall transfer the information contained in this Clause to any person involved in the provision of the agreed Services, which entails the processing of their personal data.

Data subjects may request access to their personal data, rectification, erasure, objection, data portability and restriction of its processing, at the address of the other Party appearing in the heading of this Contract, as well as lodge a complaint with the Supervisory Authority for Data Protection.

LANGUAGE

CONECTIO may translate these Terms and Conditions or any other policy that may be published on the Platform. The Spanish version shall prevail in the event of conflict with other translations.

OUT-OF-COURT DISPUTE RESOLUTION

For the resolution of any discrepancy, question or claim arising directly or indirectly from the interpretation or execution of these Terms and Conditions, the parties waive any jurisdiction that may correspond to them and submit to the jurisdiction of the Courts and Tribunals of the city of the User's domicile.

Pursuant to the provisions of Regulation (EU) No 524/2013 of the European Parliament and of the Council, of 21 May 2013, on online dispute resolution for consumer disputes, CONECTIO informs you that, in the event of a dispute, Users residing in the European Union may turn to the "Online Dispute Resolution Platform" developed by the European Commission, with the aim of attempting to resolve out of court any dispute arising from the provision of services by CONECTIO.
